Terms and Conditions
Studio Willow Glen, operated under Setoguchi Fitness LLC, provides access to small class group fitness classes. By using the gym and accessing the premises, you agree to the following terms and conditions:
1. General Rules and Expected Behavior:
You must follow all gym rules and regulations as posted within the facility.
You are responsible for your own safety and the safety of others while using the gym premises.
Any damage caused to the gym equipment or facilities due to negligence or misuse may result in financial liability.
2. Membership and Financial Commitments:
By signing up for a membership, you agree to pay the specified fees and charges as outlined in the membership agreement.
Membership fees are non-refundable and non-transferable.
Monthly membership fees will be automatically charged to the provided payment method.
Failure to make timely payments may result in suspension or termination of your membership.
3. Cancellation Policy:
To cancel your membership, a written notice must be submitted at least 30 days in advance.
No refunds will be issued for the unused portion of the membership.
Membership cancellation does not relieve you of any outstanding payment obligations.
4. Child Care Assist:
Our child care services are available exclusively to members and their children. All children must meet the minimum age requirement of [insert age, e.g., 6 months] and the maximum age of [insert age, e.g., 12 years] to be admitted into the child care facility.
Child care services are available on a first-come, first-served basis. Reservations are recommended and can be made up to [insert time frame, e.g., 24 hours] in advance. Drop-ins are accepted based on availability.
Parents/guardians must remain on the premises while their child is in the care of our child care team. Parents/guardians are required to sign their child in and out and provide emergency contact information during each visit.
For the safety of all children, any child showing signs of illness (fever, rash, vomiting, etc.) will not be admitted into the child care facility. Parents/guardians must provide any necessary allergy information or medical instructions in writing.
While our child care team takes every precaution to ensure a safe and enjoyable environment, the gym is not responsible for any injuries, accidents, or illnesses that may occur during child care. Parents/guardians assume full responsibility for their child’s participation in this service.
We strive to create a positive and respectful environment. If a child exhibits behavior that poses a risk to themselves or others, parents/guardians will be notified and may be asked to remove the child from the facility.
Child care services are subject to a fee of $10 per hour. Payment is due at the time of booking or upon arrival.
The gym is not responsible for any lost or stolen personal items. Parents/guardians are encouraged to label all belongings and avoid bringing valuables to the child care facility.
5. Notifications and Waiver Release:
By using the gym facilities, you grant Studio Willow Glen permission to send you notifications related to your membership, updates, and promotions via email, SMS, or other communication channels.
Studio Willow Glen is not responsible for any injuries, accidents, or damages that may occur while using the gym facilities.
By using the gym, you agree to release Studio Willow Glen and its affiliates from any liability. Please read and understand these terms and conditions carefully before using the gym facilities. Your use of the gym premises indicates your acceptance and agreement to comply with the terms and conditions stated above.
Studio Willow Glen Liability Waiver
I, hereby acknowledge and agree that by entering Studio Willow Glen, owned and operated by Setoguchi Fitness LLC, I am doing so at my own risk. I understand and accept that the gym will not be staffed, and it will be open 24 hours.
I hereby waive any and all liability claims, actions, causes of action, or demands of any nature whatsoever, including but not limited to those arising from negligence, against Setoguchi Fitness LLC, its owners, employees, agents, and representatives, for any injury, loss, damage, or harm that may arise from my use of the facilities and equipment at Studio Willow Glen.
I understand and acknowledge that I have watched the safety video regarding how to use every and all pieces of equipment in the Studio Willow Glen studio and that the use of the gym and its equipment involves certain inherent risks, including but not limited to the risk of serious bodily harm, injury, or even death. I voluntarily assume all such risks and waive any claims or rights to seek compensation for any injury or damage that may occur.
I confirm that I am physically fit and have no medical conditions that would prevent me from safely using the gym facilities. I agree to abide by all gym rules and regulations, and I understand that failure to do so may result in the termination of my membership.
I also acknowledge that Setoguchi Fitness LLC and its representatives are not responsible for the actions or behavior of other gym members or individuals present at Studio Willow Glen.
By signing below, I acknowledge that I have read and understood the terms of this liability waiver, and I voluntarily and knowingly agree to its contents. I understand that this waiver is binding upon myself, my heirs, executors, administrators, and assigns.
Membership Contracts
All memberships come with a 30 day notice to cancel. In the event of an injury your 30 day notice may be waived after a doctors note has been submitted. All memberships come with a 6 week max availability to suspend, you must notify us 2 weeks prior before leaving and fill out our suspension form. A $20 admin suspension fee will be added every time you suspend.
